The compulsory mediation shall be conducted in Accra, Ghana; shall be led by 3 mediators (1 selected by you, 1 selected by OSI and the third selected by the first two mediators) located in Accra, Ghana; and the mediation session(s) shall be held in Accra, Ghana.

You understand and agree that, except as expressly provided herein, there shall be no third party beneficiary to these Terms of Use and the agreements contained herein.

You understand and agree that if a court of competent jurisdiction determines that any provision of these Terms of Use is unenforceable, then such term will be eliminated and the remaining terms and conditions shall remain in full force and effect.

You understand and agree that failure by OSI to exercise or enforce any specific right or provision of these Terms of use shall not constitute a waiver of said right or provision, and no waiver shall be enforceable unless in writing and signed by the party against whom enforcement is sought.

You understand and agree that the headings in these Terms of Use are inserted herein for convenience only, and have no legal or contractual effect.
